VirtuaLAN Terms of Service

These terms of service are subject to change at any time.
These Terms of Service are an agreement between the user (hereafter referred to as “you”, the user, or users in plural) and KendallCon (hereafter referred to as “the service provider"), regarding the access and usage of the VirtuaLAN VPN Service (hereafter referred to as “the service"). These terms of service are legally binding, and violation of the terms of service may result in administrative actions, prohibition from access of the service, and/or pursuance of legal action.
The service is provided, free of charge, to all users. No guarantee of service uptime is expressed or implied. The service provider reserves the right to shutdown the service with no advance notice to you. No guarantee of time-to-uptime after power or network outage events is made.
The service provider shall regularly shut down the service for maintenance, with an expressed intention to do so weekly. The service provider makes no guarantee to the scheduling of maintenance operations, and is not obliged to provide any advance notice to you.
The service is not open to the general public; access to the service is afforded to you by the service provider contingent upon relevant tenure in the service provider’s community events and Discord server. At the service provider’s discretion, assessed upon a per-case basis, eligibility is determined by factoring your tenure, repute and activity within the service provider’s community spaces and/or events, with sufficient proof allowing for eligibility to use the service. Further, no user who has been a member of the community Discord server for less than 30 days will be permitted for eligibility. There are no hard exceptions to this policy.
Certain usages of the service are prohibited, and violation of such restrictions may result in you being permanently ineligible for future access to the service.
The service provider reserves the right to restrict service to any user, at any time, for any reason.
The service provider forbids any activity by user(s) which may be construed as harassment of any other user(s) on the service. This includes unauthorized distribution of private materials, personal details, or content distributed with the intent to harass, demean or harm any other user(s).
The service provider forbids any user from engaging in portscanning, DoS flooding, broadcast flooding or any other activity which may disrupt normal operations of the service without the explicitly expressed permission of the service provider. Users found to be in violation of this policy will be immediately removed from the service.
In the event of such activity happening unbeknownst to the offending user, the service provider may elect to re-instate the offending user’s account status after suffucient proof is provided that the issue causing such activity is acceptably resolved.
Any user found to be hosting illicit explicit material will be removed from the service, and will be reported directly to the appropriate authorities. Such material shall include, but not be limited to: photos and/or videos of criminal activity, pornographic content of underage persons,
Accounts are not linked to legal identity. Logs are kept of account activity, but are scrubbed within 72 hours in a rolling log cycle. User account info is not allowed to be made available to any third party, for any reason. Logs are only inspected at the behest of the system administrator. All traffic to and from the server is encrypted, and is not decrypted by the server or system administrator at any point. While packet traffic activity may be logged by the server, all encrypted data on the network remains encrypted. We pledge to never provide user data to any third party, for any reason.
